The holder of a Class “B” licence is a person subject to the registration requirements of Part 2 who meets the definition of “dealer” (§ 1.1) and whose activity consists of buying and/or reselling an animal. This term includes brokers and operators of an auction, as these people negotiate or arrange for the purchase, sale or transport of animals in trade. These individuals generally do not assume physical ownership or actual control of the animals and generally do not keep the animals in facilities. A Class “B” licence holder may also display animals as a minor part of the warehouse. Institutional official means the person at a research institution who is authorized to legally commit on behalf of the research institution that the requirements of 9 CFR Parts 1, 2 and 3 will be met. For the purposes of this subchapter, unless the context otherwise requires, the following terms have the meanings ascribed to them in this section. The singular form should also mean the plural and the masculine form should also mean the feminine. Words that are not defined in the following paragraphs must have the meaning ascribed to them in everyday language, as expressed in the definitions of a standard dictionary. Intermediary means any person, including a division, agency or agency of the United States or a state or local government (other than a dealer, research institution, exhibitor, person excluded from the definition of a dealer, research center or exhibitor, auction operator or carrier) engaged in any commercial activity; in which it obtains custody of animals in connection with their transport in commerce. Retail Pet Store means a place of business or residence where the seller, buyer and animal for sale are physically present so that each buyer can personally observe the animal prior to purchase and/or take care of it after purchase, and where only the following animals are sold or offered for sale: In retail stores, For domestic use: dogs, cats, rabbits, guinea pigs, hamsters, gerbils, rats, mice, ground squirrels, chinchillas, domestic ferrets, domestic farm animals, birds and cold-blooded species. This definition excludes: – Class “A” licensee (breeder) is a person subject to the licensing requirements of Part 2 who meets the definition of “trader” (§ 1.1) and whose activity with animals consists solely of animals raised on site in a closed or stable colony and animals acquired solely for the purpose of maintaining or improving the breeding colony.
Exotic animal means any animal not included in the definition of “animal” in this Part, originating in a foreign country or of foreign origin or character, not originating in the United States or imported from abroad. This term includes animals such as, but not limited to, lions, tigers, leopards, elephants, camels, antelopes, anteaters, kangaroos and water buffaloes, as well as foreign domestic cattle species such as ankole, gayal and yak. mutt m (mutten singular defined, muttar plural indefinite, muttan plural defined) Outdoor home installation means any structure, building, land or land, dwelling or land, dwelling or intended to house animals that does not meet the definition of another type of housing facility in the regulations and in which temperatures cannot be controlled within specified limits. The holder of a Class “C” licence (exhibitor) is a person subject to the permit requirements of Part 2 who meets the definition of an “exhibitor” (§ 1.1) and whose activity consists of displaying or presenting animals to the public. A Class “C” licence holder may purchase and sell animals as a minor part of the business in order to maintain or expand their collection of animals. mutt (mutt singular indefinite, singular definite and plural mutte, comparative muttar, muttast superlative indefinite, certain button of superlative courage) Mutt can now be used with affection or contempt to refer to a dog that is not purebred, but in the ancient history of the word, in the United States at the turn of the 20th century, it could also be used, to describe a person – and not friendly: Mutt was another word for “fool”. The history of the word lies in another insult. This comes from the sheep`s head, another Americanism that essentially also means “fool.” The sheep`s head had existed since the beginning of the 19th century, but it was reminiscent of an older insult with the same meaning: people called themselves “sheep`s heads” since the middle of the 16th century. Person means any natural person, partnership, business, corporation, corporation, association, trust, estate or other legal entity. A licence holder is any person who holds a permit issued under the provisions of the Act and the provisions of Part 2 of this subchapter. For the purposes of Sub-Section C of Part 2 of this Subchapter, activity means those elements of research, testing or teaching procedures that involve the care and use of animals. Positive physical contact means stroking, petting or other touching, which is beneficial for the animal`s well-being.
The exhibitor is any person (public or private) who exhibits animals purchased in the course of trade or whose intended distribution affects or will affect the trade to the public in order to receive compensation, as determined by the secretary. This term includes carnivals, circuses, animal acts, zoos and educational exhibits that exhibit such animals, whether they are run for profit or not. This term excludes retail pet stores, horse and dog racing, the owner of an ordinary domestic pet who derives less than a substantial portion of his income from a non-primary source (as determined by the Secretary) for the display of an animal that resides exclusively at the residence of the owner of the animal, sponsoring organizations, and any person attending national and rural fairs. Livestock shows, rodeos, field trials, racing events, purebred dog and cat shows and any other fair or exhibition promoting the agricultural arts and sciences, as determined by the Secretary. Primary transportation is the primary means of transportation used to transport an animal from origin to destination, such as a motor vehicle, airplane, ship or train. Federal Research Agency means any department, agency, or agency of the United States that uses live animals for research or experimentation. The wild state means to live in its original natural state; undomesticated. Licensed Veterinarian means a person who has graduated from an accredited veterinary school or has received equivalent formal training as determined by the administrator and who holds a valid license to practice veterinary medicine in a state. The administrative unit is the organizational or management unit at the departmental level of a research institution. (3) any establishment or person that sells warm-blooded animals (other than birds, laboratory rats and mice) for research or exhibition purposes; Interactive Zone means the area in a main enclosure for a dolphin swimming program where an interactive session takes place. `protective maintenance` means a facility that provides shelter for animals; protection from the elements; and protection against extreme temperatures at all times.
A protected residential complex may consist of runways or pens completely enclosed in a barn or building, or the connection of indoor and outdoor trails or stables to the interior pins of a fully enclosed building. Minimum horizontal dimension (MHD) means the diameter of a circular water basin or, in the case of a square, rectangular, elongated or differently shaped basin, the diameter of the largest circle that may be inserted within the boundaries of such a basin. Wild animal means any animal found now or historically in the wild or wild within the borders of the United States, its territories or possessions. This term includes, but is not limited to, animals such as: deer, skunk, opossum, raccoon, mink, armadillo, coyote, squirrel, fox, wolf. APHIS Agent means any person employed by the Department who is authorized to perform a function in accordance with the law and regulations of 9 CFR Parts 1, 2 and 3.
