State Legal Holidays

Although federal and state governments have set public holidays, this does not necessarily mean that all employers are required to give workers time off on those days or pay workers higher wages for working on designated holidays. With the exception of private employers in Massachusetts and Rhode Island, no other state or federal government requires private employers to provide their employees with leave for state-designated holidays or to make additional payments if they do so. We have provided a brief history and additional information on the following federal holidays: Columbus Day/Indigenous Peoples Day, Veterans Day, Labour Day. In addition to the statutory holidays indicated, excluded employees are entitled to one personal leave per fiscal year. The federal and all state governments have passed laws that designate certain days as holidays each year. Although there are several days per year that are recognized as statutory holidays by the federal government and all state governments, each state recognizes additional days each year that may or may not be recognized by other states. The following is a list of days designated as statutory holidays by the federal government: For federal employees who work Monday to Friday, if one of the holidays listed above falls on a Saturday, it will be observed the previous Friday. For employees who do not work Monday to Friday, when a public holiday falls on a day on which they are not expected to work, the business day immediately preceding the unscheduled business day is the employee`s public holiday. For federal employees who have jobs outside the United States, have a basic work week other than Monday through Friday, and are scheduled to work regularly on Mondays, they are aware of holidays, which typically fall on the Monday of the first business day of the work week in which the holiday falls. U.S.

Code 5-6103 On the other hand, most states and the federal government have laws that require public employers to grant employees leave during some or all holidays or to provide employees with additional compensation if they do. However, in a minority of states, the law is either silent on leave for public sector employees or explicitly delegates the decision on leave to a specific state authority. To be eligible for personal leave, the employee must: (a) be appointed to a class that requires a probationary period; (b) be appointed to an exempt position in which leave credits are vested; or (c) be appointed to a Career Executive Assignment (CEA) position for more than six months. Once eligible employees have completed six months of their initial probationary period, they will receive a personal leave of absence for the current fiscal year. Thereafter, the personal leave is credited on July 1 of each year. *If a statutory holiday falls on a Saturday, employees receive vacation credits. ** If a holiday falls on a Sunday, the holiday is celebrated on the following Monday.
