People who are legally coming to the UK to accompany their partner in a marriage or civil partnership must submit the appropriate visa application according to their situation. This process is usually expensive and time-consuming. There is no definition of an irregular migrant (or “illegal immigrant”) in UK law. However, it is generally accepted that there are four main ways for a person to become an irregular migrant (Figure 1): It is important to understand that those who wish to seek asylum would be in great danger in their country of origin and it would not be safe for them to return. It is important to understand that once you have applied for asylum, you are no longer an illegal immigrant, but an asylum seeker. In reality, it doesn`t make much difference in your daily life, but it does mean you have some protection. Even people who enter the UK legally can become illegal immigrants. Perhaps you have crossed the country and have not left the country despite an expired or shortened visa or a refused immigration application. If you have children living with you illegally in the UK, it is important to know if you can also apply for a residence permit. If they are not registered to become British citizens or get a residence permit, they will be in trouble. Marriage solely for the purpose of obtaining regular (or legal) immigration status is a criminal offense and will be severely punished for anyone who enters into or facilitates the marriage. The UK is working closely with the French and Belgian governments to do everything possible to stop illegal migrants before they reach the UK. In 2021, French and British authorities prevented more than 23,000 attempts at illegal travel to the UK. In addition, unauthorized entry, visa overruns, illegal work and violations of other visa restrictions are difficult for authorities to detect. In this sense, those who have entered the country illegally are considered asylum seekers until their application is approved and they are then considered refugees or rejected.
