On June 13, 2022, Ohio Senate Bill No. 215, known as the Ohio “Constitution” Act, went into effect. The new law, codified in R.C. 2923.111, allows a “qualified adult” to lawfully carry, possess or conceal a handgun without having to obtain a concealed carrying permit or submit to the background check and firearms training previously required to obtain the concealed carrying permit under RC 2923.125 (Ohio`s concealed port). Therefore, effective June 13, 2022, it is optional for a qualified Ohio adult to obtain a secret handgun license. Instead, an eligible adult can hide by wearing anywhere a licensed person can carry and has the same rights and obligations. The law clearly states that qualified adults who carry an unrestricted handgun will be treated as if they had a valid firearms licence. Each state has its own gun laws. A person entering a state is subject to that state`s specific firearms laws. Ohio`s gun laws still require that a person who owns a firearm be at least 21 years old, that the law does not prohibit the law from possessing firearms under federal or state law (e.g., a convicted felon), and that the person cannot be considered a “fugitive from justice.” According to new R.C. 2923.111, of 13. June 2022 the same right to transport and store firearms and ammunition in a private vehicle, now also for all qualified adults without concealed carrying permission.
Now that all eligible adults have the same rights as those who have obtained an undercover driver`s licence, public employers cannot enforce regulations prohibiting people without a hidden handgun licence from transporting or storing firearms or ammunition in their private motor vehicles. Therefore, public employers should consider reviewing and revising their applicable employee handbooks or policies to ensure compliance with this change in legislation. Ohio`s gun laws were amended effective June 13, 2022. Ohio is now a “constitutional port” or “port without a license” state when it comes to handguns. What does this new gun law mean in Ohio? In addition, licence-exempt carriers (those who do not have a secret transport licence) are subject to the same laws and prohibitions as CHL licence holders, with one important exception: licence-exempt transporters may NOT carry handguns in their vehicles while driving in a school safety zone. The new legislation does NOT apply to “long guns” (i.e. rifles and shotguns). Ohio`s new gun law has no residency requirement — anyone in Ohio, whether resident or not, can hide without a license. What should political subdivisions know as public employers? Hidden weapons are still prohibited in government buildings (including police stations, prisons, and courtrooms), school safety zones (unless expressly authorized), airports, and aircraft, or other locations where carrying a concealed weapon is prohibited by federal law. See RC. 2923.126. However, according to R.C. 2923.121, political subdivisions should ensure that they are appropriately signposted and posted at entrances, exits and other conspicuous places of all buildings and land owned or controlled by the State where the carrying of concealed handguns is prohibited. According to the law, such signage must include a statement essentially in the following form: “Except as otherwise authorized by law, no person under the Revised Ohio Code shall knowingly possess, control, transport or attempt to transfer into such premises any lethal weapon or dangerous ammunition or dangerous munition.” See R.C. 2923.121. According to R.C. 2923.1210, employees with a concealed carrying permit may legally transport and store their firearm and ammunition in their private motor vehicle if an employee`s vehicle is parked in a place where it is otherwise authorized.
Or it is locked in the trunk, glove compartment or other closed compartment or container in the employee`s private motor vehicle when the employee leaves the vehicle. Stowaways who have an “official interaction” with police or other law enforcement agencies – for example, a traffic check – are no longer required to immediately inform the officer that they are carrying a concealed handgun. In addition, Ohio`s new law still allows public employers to establish, maintain, and enforce the same reasonable, equally enforced workplace policies that prohibit employees from carrying handguns or firearms on state buildings or state vehicles as before. However, since 2017, public employers have been prohibited from establishing, maintaining or enforcing policies or rules that would prohibit a person holding a valid concealed carrying permit from transporting or storing their firearm or ammunition in their private motor vehicle, even if the vehicle is parked on public employer property. R.C. 2923.1210. What is a “qualified adult” under the new law? Under new R.C. 2923.111, a “qualified adult” means a person 21 years of age or older who is not prohibited by law from possessing or obtaining a firearm under federal or state law, and who meets various other criteria set out in R.C. § 2923.111(A)(2)(a) and R.C. § 2923.125(D)(1)(a)-(j), (m), (p), (q) and (s) are listed, In short, in Ohio, a person is no longer required to obtain a secret handgun license (CHL) to possess a handgun concealed on his person and/or vehicle.
In addition, CHL holders are no longer required to wear their CHL card face down on their body. Anyone who purchases firearms from a licensed firearms dealer must still be screened by the National Instant Criminal Background Check System. This background check verifies felony convictions, dishonorable military release, and involuntary admission to psychiatric facilities. To the extent that policies, procedures and practices are revised or repealed in light of Ohio`s new constitutional law, policy subdivisions should notify their employees as soon as possible and ensure that they comply with all obligations set out in an applicable collective agreement. Policy subdivisions should also closely monitor applicable law and be prepared to take proactive steps to adapt policies and practices as new guidelines or decisions become available. The new legislation also states that all lawful firearm bearers (for example, adults qualified under the new law, as well as those with the now optional concealed licence) are no longer required to immediately notify law enforcement officers that they are carrying a concealed firearm during an official inspection. Instead, they can only reveal that they are carrying a hidden weapon if the officer asks them directly. Municipal police departments as well as county sheriff`s offices should ensure that their patrol officers/deputies are fully aware of this significant change and are following procedures that comply with regulations. Businesses will still be allowed to post signs prohibiting firearms in their buildings, such as grocery stores and liquor stores, and carrying a hidden firearm in a school building, courthouse or school grounds will continue to be prohibited. Anyone can carry a loaded handgun in their vehicle and that loaded handgun can be stored anywhere in the vehicle. An important exception, as described above, is that an “unlicensed carrier” of a firearm may NOT carry a handgun in their vehicle while driving in a school safety zone.
